Terms of Service
Last updated September 24, 2026
These Terms govern your use of The Quote Assist (the "Service"), a web-based mortgage lead management, quoting and borrower-texting platform. The Service is provided by Survivors, LLC ("we", "us"). By accessing or continuing to use the Service, you agree to these Terms and are contracting with Survivors, LLC.
1. Eligibility and accounts
If you use the Service on behalf of an organization, you confirm you have authority to bind it; otherwise you confirm you are of legal age. You must provide accurate information, keep it up to date, and keep your login credentials confidential. You are responsible for activity under your account.
2. Licence
We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan and seat count. You may not reverse engineer, resell, redistribute or circumvent technical limits of the Service.
3. Acceptable use
You must not misuse the Service, including by:
- using it for unlawful purposes, including sending texts or calls without the consent required by law (e.g. TCPA) or to numbers that have opted out;
- fraud, spam or misleading communications to borrowers;
- infringing anyone's intellectual property;
- interfering with security, introducing malware, probing, or scraping the Service.
You are responsible for your own licensing, disclosures and compliance with mortgage and consumer-protection laws. Quotes produced by the Service are estimates and must be reviewed by a licensed loan officer.
4. Your content
You keep ownership of the lead and borrower data you upload. You grant us a limited licence to host and process it solely to provide the Service.
5. Intellectual property
Survivors, LLC retains all rights in the Service, including its software, documentation and branding.
6. Payment, subscriptions and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, renewal, taxes, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew monthly until cancelled; cancellation takes effect at the end of the current billing period. See our Refund Policy.
7. Service level
We work to keep the Service available, but we do not guarantee uninterrupted or error-free performance. Third-party services (texting carriers, CRMs, data providers) may affect delivery.
8. Suspension and termination
We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. After termination you may request an export of your data within 30 days; after that it may be deleted.
9. Warranties and liability
To the fullest extent permitted by law, the Service is provided "as is" without implied warranties of merchantability or fitness for purpose. We are not liable for indirect, consequential or special damages (including lost profits, data or goodwill). Our total liability is capped at the fees you paid in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury where the law does not allow it.
10. Indemnity
You will indemnify Survivors, LLC against claims arising from your content, your communications to borrowers, unlawful use, or breach of these Terms.
11. General
These Terms are governed by the laws of the State of California, with disputes resolved in the courts of Orange County, California. You may not assign these Terms without our consent; we may assign them in a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. A signed customer agreement with us takes precedence over these Terms where they conflict.
